Terms of Service
These terms of service (TOS) are entered into between OMIT (OM-IT, we, us, or our) and the entity purchasing our using
services provided by or through OMIT (Customer, you, or your). We agree
to be bound by this TOS when we process your payment information. You agree to
be bound by this TOS when you submit the contact information set out below. This
TOS contains provisions that you are required to apply to your customers (End
Users). It is your responsibility to ensure that these provisions are included
in contracts and other agreements with your End Users. You are responsible for
your End Users under this TOS. If you intend to resell the Services, you must
also agree to be bound by our Reseller Agreement.
Any technical difficulties caused by the client on his control panel, Osama Masr
for IT (OMIT) not obligated to fix it, but if the client needs to restore it
back Osama Masr will charge the client a fee, that depends on the nature of the
problem and time needed to fix it Client has to follow how it is works on his
design and develop so we can deliver it on time Payment in full for the Domain
name and hosting service before registration Domain Name has to be written
clearly (preferred to be typed and printed). If any errors resulted in failure
of the Domain on the part of the client, OMIT is not responsible for it Client’s
payment for 50% of his/her designs and/Or 50% of his development in advance
before starting the remaining of the payment is of the project Basic changes in
developing and designing will be allowed for fee for extra services Transferring
from the old domain company to us, payment is expected in advance for 200% of
the domain price. The reasoning is the domain will be renewed for two years not
just one year. Authentication Code of the domain has to be provided in order for
the company to transfer it. This process might take up to 5 days for the time
everything required is submitted in case of the client would like to discontinue
our services and would like to keep the work and design, a payment of a minimum
of at least 50% of the original agreement is due OMIT not responsible anymore if
her client delayed the needed data for 30 days, OMIT will consider the project
is done, and client has no right to get back his money The company obligated to
represent its authorized client and has to have a written official authorization
from the company, has to be attached with their contract When the authorized
person has ended his job with the company, Company has to send us a written
(e-mail or a fax) to let us know to stop working with him, and if not, OMIT is
not responsible for anything at all Terms of usage, Conditions and Agreement
البنود والشروط الواجب إتباعها من قبل المشترك :
أى خطأ فنى فى لوحة التحكم الخاصة بالإستضافة (الهوست) ناتج عن سوء إستخدام
المستخدم، لا تتحمله الشركة ولا يقع تحت مسئوليتها وفى حالة رغبة المشترك فى
إستعادة الإعدادات الخاصة به يلتزم بدفع قيمة مادية تقدر بحجم الخطأ أو المشكلة
التى تسبب فيها. يلتزم المشترك أو المفوض بمتابعه خط سير العمل على الموقع بشتى
مجالاته بدءً من التصميم وإجراء التعديلات التى يراها ضرورية قبل الإنتهاء من
التصميم بشكل نهائى حتى يتم تسليم الموقع فى الوقت المحدد والمناسب على حسب حجم
العمل عليه. يجب الإلتزام بدفع قيمة إسم الموقع (الدومين) و الإستضافة بالكامل
وبقيمتهما الكاملة مقدماً قبل البدأ فى عملية تسجيل أياً منهما إذ أن عملية التسجيل
تتم بشكل فورى. يجب على المشترك كتابة إسم الموقع الخاص به والمراد تسجيله بخط واضح
وسليم وتفضل بأى وسيلة من الوسائل الإلكترونيه كبريد إلكترونى أو رساله نصية من
الموبايل أو مطبوع، وبالتالى فإن تسجيل الدومين بشكل خاطئ هو مسئولية المشترك
مسئوليه كاملة ويلتزم بدفع قيمته بالكامل ولا يحق له إسترداد قيمته بالمرة. قيم
التصميم والتطوير فيجب دفع ٥٠ ٪ من إجمالى القيم المستحقة عن التصميم والتطوير قبل
البدأ فى التصميم أو التطوير ويتم دفع باقى القيم المستحقة بالكامل عند تسليم
الموقع على الإنترنت. التعديلات الجوهرية فى التصميم أو التطوير أو أعمال الفلاش
بعد البدأ فى التنفيذ وبعد الإتفاق والتى تؤدى لتغيير شكل الموقع بالكامل ستضاف
تكلفه التعديلات كتكلفة تصميم جديد تضاف إلى مجمل القيم المستحقة على المشترك
وللعميل الحق بالإحتفاظ بالنسخ القديمة والتعديلات الجوهريه. وبمجرد طلب الخدمة من
الشركة المالكة للدومين Authentication Code عند رغبه المشترك فى نقل إسم موقعه من
شركة أخرى إلينا يجب عليه نقل مايسمى بال الدولية والتى ICANN وموافقتها على عمليه
النقل تتم فى فترة زمنيه قد تصل إلى خمسة أيام عمل متصلة مع مراعاة أن عمليه النقل
تتم طبقا قواعد منظمة ال تقتضى أن يتم تجديد الدومين لسنتين متتاليتين مع الشركة
الجديدة (التى تمثلها شركتنا) وبالتالى لزم على المشترك بدفع قيمة شراء الدومين عن
العامين مجتمعين. فى حالة رغبه العميل فى عدم إستكمال باقى خطوات العمل على موقعه
تعتبر القيمة التى دفعها المشترك وهى ٥٠ ٪ من قيمة المشروع (تصميم وتطوير أو أحدهما
فقط على حسب طلب المشترك) لايجوز له إسترداد القيم المدفوعه لأنها مستحقة للشركة
نظير ماقدمته من قبلها من خدمات تجاه المشترك. أما فى حالة عدم البدأ فى التنفيذ
يتم خصم ٢٥ ٪ من إجمالى القيم المدفوعه. تقعص أو تأخر المشترك فى تقديم البيانات
اللازمة لإتمام الموقع لمدة تصل إلى ٣٠ يوماً متصلة سيتم إعتبار الموقع منتهيا
ولاتقع أيه مسئولية بأى شكل من الأشكال تجاة الشركة ولايحق له المطالبه بأيه مبالغ
نقدية بالمرة. إلا إذا رغب فى إستكمال سير العمل على الموقع وجب عليه تسديد قيم
التصميم والتطوير مرة أخرى. فى حالة تعاقد الشركات لزم عليها تفويض أحد موظفيها
لمتابعه العمل على الموقع وعلى أن يتم إرسال التفويض بإحدى وسائل الإتصال المختلفه
للشركة مبينه فيها تفويض الموظف لمتابعه سير العمل على الموقع. فى حالة إنهاء عمل
الموظف المفوض يجب على الشركة المفوضة للموظف إخطارنا بأى شكل من الأشكال لمدة
لاتزيد عن إسبوع كامل بدءً من ترك الموظف المفوض للشركة حتى نتخذ اللازم وإلا فإنه
لاتقع علينا أيه مسئوليه تجاه هذه الشركة بالمرة.
